(aka Pocket Hose) Class Action Settlement

All persons who purchased for personal consumption, and not for re-sale, the product the Pocket Hose (the “Covered Products”), in the United States, its territories, or at any U.S. Military facility or exchange, from November 6, 2009 until January 30, 2014, could receive compensation from a Class Action Settlement.

This is to notify you that you may be a member of the class (the “Class”) in a lawsuit that may affect you and that there is a Settlement Agreement in that lawsuit. A Settlement has been reached between TeleBrands Corporation (“Defendant”) and Plaintiffs (“Class Representatives” or “Plaintiffs”), individually and on behalf of the Settlement Class.

The Settlement resolves a Class Action lawsuit relating to Defendant’s product the Pocket Hose (the “Covered Products”). The lawsuit alleges that some of the advertising and product labels for the Covered Products contain unsubstantiated or misleading statements and that the Covered Products were defective. Defendant denies all allegations of wrongdoing and liability asserted in the Lawsuit. The Court has made no determination that any of the allegations are true, and has made no finding of liability or wrongdoing. The lawsuit does not claim that the Covered Products are unsafe.

The Settlement provides cash payments to class members.

SUBMIT A CLAIM The only way to receive monetary compensation.
EXCLUDE YOURSELF This is the only option that allows you to be part of any other lawsuit against Defendant about the Covered Products.
OBJECT Tell the Court about why you don’t like the Settlement.
GO TO A HEARING Ask to speak in Court about the Settlement.
DO NOTHING Get no monetary compensation. Give up rights to be part of any other lawsuit about the Covered Products, other than claims for personal injury arising from the use of the Covered Products.

The Court in charge of this case still has to decide whether to approve the Settlement. Compensation will be issued only if the Court approves the Settlement and after the time for appeals has ended and any appeals are resolved. Please be patient.
